FTPA has built a strong and recognized practice in arbitration and alternative dispute resolution.
We advise and represent French and foreign clients in domestic and international arbitrations, whether under French or foreign substantive laws, and act in ad hoc arbitrations or arbitrations administered by the main international institutions such as the International Chamber of Commerce (ICC), the London Court of International Arbitration (LCIA), the Singapore International Arbitration Centres (SIAC), the Arbitration Foundation of South Africa (AFSA), the Mediation and Arbitration Centre of the Mauritius Chamber of Commerce (MARC), or the International Centre for Settlement of Investment Disputes (ICSID).
We are involved in the drafting of certain rules of arbitration and more generally in reflecting on ways of improving and modernising services offered by international institutions. Some of our members act as arbitrators and are listed on arbitrator panels of international institutions (MARC, AFSA).
Our team also assists clients in pursuing alternative and/or amicable dispute resolution mechanisms such as mediation or conciliation processes and participative procedures. Some of our members are trained mediators and can be appointed by parties to a dispute or judicially.
We act for clients, companies, and their in-house legal teams, on complex technical disputes requiring full knowledge of proceedings and a strong expertise in technical, financial, and legal issues that are likely to arise in such proceedings.
Our dedicated multicultural team regularly acts in arbitration or mediation proceedings in construction (including contracts involving foreign State entities) and industrial disputes, in commercial disputes, termination of established commercial relationships involving distributors, foreign commercial agents or franchise agreements, as well as indemnification claims or disputes arising between shareholders.
We also appear before national courts in enforcement or setting aside proceedings relating to arbitral awards or related exequatur orders.
