L&#8217;affaire Kerviel, le fameux trader de la Soci\u00e9t\u00e9 G\u00e9n\u00e9rale, licenci\u00e9 pour faute lourde en 2008 est \u00e9difiante \u00e0 ce titre.<\/p>\n<p><strong>Faute grave vs faute lourde : quelle diff\u00e9rence ?<\/strong><\/p>\n<p style=\"font-weight: 400;\">\nLe salari\u00e9 qui se rend coupable de faits d&#8217;une gravit\u00e9 telle que son maintien dans l&#8217;entreprise devient impossible, peut \u00eatre licenci\u00e9 pour faute grave. Tel est le cas notamment d&#8217;actes d&#8217;insubordination, d&#8217;insultes prof\u00e9r\u00e9es contre la hi\u00e9rarchie, des absences injustifi\u00e9es ou encore de la d\u00e9loyaut\u00e9 envers l&#8217;entreprise. Il s&#8217;agit d&#8217;une faute grave, doubl\u00e9e de l&#8217;intention de nuire \u00e0 l&#8217;employeur. La preuve des faits constitutifs de faute lourde incombe \u00e0 l&#8217;employeur exclusivement.
