Cet arr\u00eat du 16 mars 2021 va-t-il faire jurisprudence et permettre aux salari\u00e9s victimes d&#8217;un licenciement abusif d\u2019\u00eatre mieux indemnis\u00e9s ?<\/strong><\/p>\n<p style=\"font-weight: 400;\"><strong>Licenciement abusif : ce qu\u2019il faut savoir sur le bar\u00e8me de plafonnement des indemnit\u00e9s prud\u2019homales<\/strong><\/p>\n<p style=\"font-weight: 400;\">Depuis les ordonnances Macron de septembre 2017, en cas de licenciement sans cause r\u00e9elle et s\u00e9rieuse, les juges des tribunaux de prud\u2019hommes n\u2019ont plus une enti\u00e8re libert\u00e9 dans la fixation des indemnit\u00e9s de dommages et int\u00e9r\u00eats. Ils doivent se r\u00e9f\u00e9rer \u00e0 un\u00a0<strong>bar\u00e8me<\/strong>\u00a0bas\u00e9 sur l\u2019anciennet\u00e9 du salari\u00e9 dans l\u2019entreprise avec un plancher (1 mois de salaire brut) et un plafond (20 mois de salaire \u00e0 partir de 29 ans d\u2019anciennet\u00e9).<\/p>\n<p style=\"font-weight: 400;\">Avant cette r\u00e9forme, il n\u2019y avait pas de plafond mais juste\u00a0<strong>un minimum de 6 mois de salaire<\/strong>\u00a0pour tout collaborateur ayant plus de 2 ans d\u2019anciennet\u00e9 dans une entreprise d\u2019au moins 11 personnes. Dans ce cas pr\u00e9cis, un salari\u00e9 pouvait esp\u00e9rer entre 3 mois et 3,5 mois de salaire.\u00a0<strong>Donc deux fois moins qu\u2019avant les ordonnances Macron<\/strong>.<\/p>\n<p style=\"font-weight: 400;\"><strong>16 mars 2021 : le plafonnement des indemnit\u00e9s prud\u2019homales en cas de licenciement abusif de nouveau chahut\u00e9\u00a0<\/strong><\/p>\n<p style=\"font-weight: 400;\"><strong>Dans un arr\u00eat du 16 mars 2021 n\u00b0<\/strong><strong>\u00a019\/08721<\/strong>,\u00a0la cour d\u2019appel de Paris vient d\u2019\u00e9carter ce bar\u00e8me dans le cadre d\u2019une affaire opposant une salari\u00e9e de 53 ans, licenci\u00e9e pr\u00e8s de 4 ans apr\u00e8s son embauche, \u00e0 son employeur. Et ce, alors que le licenciement \u00e9tait injustifi\u00e9 et que donc, le bar\u00e8me Macron pouvait en th\u00e9orie s\u2019appliquer pour fixer le montant de l\u2019indemnisation. Pourquoi cette non application du bar\u00e8me ?<\/p>\n<p style=\"font-weight: 400;\">\u00ab La cour d\u2019appel a estim\u00e9 que le montant pr\u00e9vu par le bar\u00e8me Macron ne permettait pas une indemnisation ad\u00e9quate et appropri\u00e9e du pr\u00e9judice subi par la salari\u00e9e \u00bb, souligne Elvira Martinez, avocate sp\u00e9cialis\u00e9e en droit social au sein du cabinet FTPA.<\/p>\n<p style=\"font-weight: 400;\">La cour d\u2019appel pr\u00e9cise que \u00ab cette somme repr\u00e9sente \u00e0 peine la moiti\u00e9 du pr\u00e9judice subi en termes de diminution des ressources financi\u00e8res depuis le licenciement \u00bb. Et d\u2019ajouter que \u00ab compte tenu notamment de l\u2019effectif de l\u2019entreprise, des circonstances de la rupture, du montant de la r\u00e9mun\u00e9ration vers\u00e9e \u00e0 Mme X, de son \u00e2ge, de son anciennet\u00e9, de sa capacit\u00e9 \u00e0 trouver un nouvel emploi eu \u00e9gard \u00e0 sa formation et \u00e0 son exp\u00e9rience professionnelle et des cons\u00e9quences du licenciement \u00e0 son \u00e9gard, tels qu\u2019ils r\u00e9sultent des pi\u00e8ces et des explications fournies, la cour est en mesure de lui allouer la somme de 32 000 euros \u00e0 titre d\u2019indemnit\u00e9 pour licenciement sans cause r\u00e9elle et s\u00e9rieuse. \u00bb Si la cour avait suivi le bar\u00e8me Macron, la plaignante aurait pu toucher maximum 17 615 euros.
